Professional secrecy and AI tools

Lawyers ensure the confidentiality of all information concerning a client's affairs (Code of ethics of lawyers, Code de déontologie des avocats, art. 60); notaries are bound by professional secrecy (Code of ethics of notaries, Code de déontologie des notaires, art. 35). According to the guide of the Barreau du Québec (the Quebec Bar), the mere act of entering protected information into an open, publicly accessible AI system constitutes a violation. Ask any provider where conversations go and whether they are used to train a model: at ZeniTech, your data is not used to train any third-party model.

Conflicts of interest

the check remains with your team: Lawyers avoid any situation of conflict of interest, assessed with regard to all of the firm's clients (art. 71 and 72); notaries do too (art. 30). Max collects the names of the parties and the area of law before any other question, and confirms the consultation only after the check has been done by your team, if that is your rule.

Intake, never legal advice

The Barreau writes that generative AI can improve the intake of new or potential clients, “without replacing legal advice.” A notary addressing the public must stress the general nature or limits of the information provided (art. 67). Max's welcome message says that he is the firm's AI assistant and does not give advice; when asked what to do, he offers a consultation.

Questions about fees

Lawyers provide the explanations needed to understand their fees (art. 100); notaries inform the client of the approximate cost and avoid setting it without knowing all the elements (art. 51). Max answers according to your fee schedule; the estimate for a specific file remains with the professional.

Advertising without testimonials

Neither lawyers (art. 145) nor notaries (art. 70) may use testimonials of support in their advertising. The general information pieces that Max prepares contain none, and nothing is published without your approval.

Quebec's Law 25

contract, assessment and automated decision: A firm collects only what is necessary (art. 5) and informs the person of the purposes and of their rights (art. 8). Entrusting information to a provider requires a written contract that provides for confidentiality measures (art. 18.3); a new system that involves personal information requires a privacy impact assessment (évaluation des facteurs relatifs à la vie privée) (art. 3.3), and so does a communication outside Quebec (art. 17). If the agent alone refuses a request, for example one outside your areas of practice, article 12.1 requires informing the person and allowing them to speak to someone at the firm.

Confirmation and follow-up text messages

Under Canada's Anti-Spam Legislation (Loi canadienne anti-pourriel, CASL/LCAP), the confirmation of an appointment already agreed does not require consent (art. 6(6)b)), and a request made in the last six months creates implied consent for the follow-up (art. 10(9)a) and 10(10)e)). Each commercial message identifies the firm and offers a way to unsubscribe (art. 6(2)).
