RBQ licence number on quotes and messages

The Régie du bâtiment du Québec (RBQ, Quebec's construction board) requires the licence number on estimates, quotes, contracts, statements of account and invoices, on the website and on social media, in the format “Licence RBQ: XXXX-XXXX-XX”. Members of the CMEQ (electricity) and the CMMTQ (plumbing), whose licence is issued by their corporation, are identified by that corporation's logo. Atlas's quote and follow-up templates therefore carry your number or your logo.

Estimate visit at the customer's request

Under the Consumer Protection Act (Loi sur la protection du consommateur), a contract concluded at the consumer's home at their express request is not an itinerant merchant contract, provided the consumer was not solicited elsewhere than at the merchant's address (art. 57). Atlas schedules the visit because the customer requested it, and the conversation that proves it stays in your CRM. If your team does door-to-door sales, the itinerant merchant rules apply: written contract (art. 58) and a 10-day right of cancellation (art. 59).

Quote accepted by email or text message

A quote that contains all the essential elements of the contract is deemed to be an offer (art. 54.1). If the customer accepts it remotely, your contact details, the description of the work, the total price and the terms must have been disclosed to them in advance (art. 54.4), and a copy of the contract must then be sent to them within 15 days (art. 54.7). Atlas tracks the signature; the content of the quote and the contract remains yours.

Follow-up texts and emails

Canada's Anti-Spam Legislation (Loi canadienne anti-pourriel, CASL/LCAP) does not require consent for a message that only gives the price or estimate that was requested (art. 6(6)a)). A request made in the last six months gives implied consent for other follow-ups (art. 10(9)a) and 10(10)e)). Each commercial message identifies your business and offers a way to unsubscribe (art. 6(2)).

ask only for what is needed: Only the information necessary for the purposes determined before collection is collected (art. 5), and the person is informed of the purposes and of their rights (art. 8). Atlas asks the questions on your form (address, type of work, access, equipment), nothing more. If a decision that affects the customer is made solely by the agent, for example refusing a request outside your territory, article 12.1 requires informing them and allowing them to speak to someone on your team.
